Haven App Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Haven, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and Christ Church of Winchester.

If you are using Haven on behalf of a family or household, you represent that you have authority to bind all family members to these Terms.

2. Description of Service

Haven is an internal church management application that provides:

• Member directory and contact information
• Church calendar and event registration
• Ministry and volunteer coordination
• Small group management and communication
• Prayer request sharing and tracking
• Pastoral care coordination
• Church announcements and communications
• Giving records and stewardship information
• Family and children's ministry management
• Resource sharing and document access

Haven is provided as a service to support the mission and ministry of Christ Church of Winchester. The App is not a commercial product and is intended solely for use by our church community.

3. Eligibility and Account Registration

3.1 Eligibility

Haven is available to:

• Members of Christ Church of Winchester
• Regular attendees and their families
• Church staff and leadership
• Volunteers actively serving in church ministries
• Other individuals approved by church leadership

The Church reserves the right to approve or deny access to Haven at its sole discretion.

3.2 Account Registration

To use Haven, you must:

• Provide accurate and complete registration information
• Maintain the accuracy of your account information
• Keep your login credentials secure and confidential
• Notify the Church office immediately of any unauthorized access
• Be at least 13 years of age (accounts for children under 13 must be managed by a parent or guardian)

You are responsible for all activities that occur under your account.

3.3 Account Approval

All new accounts require approval by church staff. The Church may verify your connection to Christ Church of Winchester before activating your account.

4. Acceptable Use Policy

Haven is provided to support the spiritual mission and community life of Christ Church of Winchester. You agree to use Haven in a manner consistent with:

• Biblical principles and Christian values
• The statement of faith and beliefs of Christ Church of Winchester
• Common courtesy, respect, and Christ-like conduct
• The purpose of building up the body of Christ and encouraging one another

You agree to use Haven only for its intended purposes related to church fellowship, ministry activities, and spiritual growth.

5. User Responsibilities

As a user of Haven, you are responsible for:

• Maintaining the confidentiality of your login credentials
• Ensuring the accuracy of information you provide
• Respecting the privacy settings and boundaries of other users
• Using the App in accordance with these Terms and applicable laws
• Keeping your device and Haven app updated for security
• Reporting technical issues or security concerns to the Church office
• Treating prayer requests and personal information shared by others with confidentiality and respect
• Using communication features appropriately and in accordance with biblical principles

Parents and guardians are responsible for monitoring and supervising their children's use of Haven.

6. Church Responsibilities

Christ Church of Winchester commits to:

• Maintaining Haven to the best of our ability
• Protecting the privacy and security of user information as described in our Privacy Policy
• Providing reasonable technical support during office hours
• Limiting access to member information to authorized staff and leaders with legitimate ministry needs
• Using member information only for church ministry purposes
• Notifying users of significant changes to Haven or these Terms

However, the Church does not guarantee uninterrupted or error-free operation of Haven and is not liable for technical issues, data loss, or service interruptions.

7. Prohibited Conduct

You agree NOT to use Haven to:

• Post or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Promote or engage in any illegal activities
• Share false, misleading, or deceptive information
• Violate the privacy or rights of others
• Transmit spam, chain letters, or unsolicited mass communications
• Introduce viruses, malware, or any harmful code
• Attempt to gain unauthorized access to Haven or other users' accounts
• Interfere with or disrupt the operation of Haven
• Scrape, copy, or harvest user information for unauthorized purposes
• Use Haven for commercial purposes or personal financial gain
• Share content that promotes division, gossip, or causes harm to the church community
• Use profanity or engage in inappropriate communication
• Share confidential pastoral care information about others without permission
• Misuse or abuse prayer request features
• Post content that contradicts the biblical teaching and values of Christ Church of Winchester

Violation of these prohibitions may result in immediate suspension or termination of your access to Haven.

8. Content Ownership and License

8.1 Your Content

You retain ownership of any content you submit to Haven, including:

• Profile information
• Prayer requests
• Comments and messages
• Photos and other media

By submitting content to Haven, you grant Christ Church of Winchester a limited, non-exclusive license to use, display, and distribute your content within Haven for the purposes of operating the App and supporting church ministry.

8.2 Church Content

All content provided by Christ Church of Winchester through Haven, including:

• Church announcements and communications
• Sermon recordings and teaching materials
• Ministry resources and documents
• The Haven app itself and its features

...remains the property of Christ Church of Winchester. You may not reproduce, distribute, or use church content outside of Haven without permission.

8.3 User-Generated Content

The Church reserves the right to monitor, review, and remove any user-generated content that violates these Terms or is deemed inappropriate. However, the Church is not obligated to monitor all content and is not responsible for content posted by users.

10. Intellectual Property

Haven, including its design, features, functionality, and code, is the property of Christ Church of Winchester or its licensors. You may not:

• Copy, modify, or create derivative works of Haven
• Reverse engineer or attempt to extract source code
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Haven name, logo, or branding without written permission

All trademarks, service marks, and logos used in Haven are the property of their respective owners.

11. Account Termination

11.1 Termination by You

You may terminate your Haven account at any time by:

• Contacting the Church office
• Submitting a deletion request through the App

Upon termination, your access to Haven will be removed, and your personal information will be handled in accordance with our Privacy Policy and church record-keeping requirements.

11.2 Termination by the Church

Christ Church of Winchester reserves the right to suspend or terminate your access to Haven at any time, with or without notice, for:

• Violation of these Terms of Service
• Conduct that is harmful to the church community
• Inactivity or lack of church involvement
• Termination of church membership
• Any other reason deemed appropriate by church leadership

The Church is not liable for any consequences resulting from account termination.

12. Disclaimers and Limitations of Liability

12.1 Service "As Is"

HAVEN IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Christ Church of Winchester does not warrant that:

• Haven will be uninterrupted, secure, or error-free
• The results obtained from Haven will be accurate or reliable
• Any errors or defects will be corrected
• Haven will meet your specific requirements

12.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHRIST CHURCH OF WINCHESTER, ITS STAFF, LEADERS, AND VOLUNTEERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF HAVEN, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE CHURCH'S TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO THE CHURCH FOR USE OF HAVEN (WHICH IS ZERO, AS HAVEN IS PROVIDED FREE OF CHARGE).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

12.3 Third-Party Services

Haven may integrate with or link to third-party services. The Church is not responsible for the availability, content, or practices of third-party services. Your use of third-party services is at your own risk and subject to their terms and policies.

13. Indemnification

You agree to indemnify, defend, and hold harmless Christ Church of Winchester, its staff, leaders, volunteers, and representatives from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising out of or related to:

• Your use or misuse of Haven
• Your violation of these Terms of Service
• Your violation of any rights of another person or entity
• Any content you submit to Haven

This indemnification obligation will survive termination of your account and these Terms.

14. Dispute Resolution

14.1 Informal Resolution

In keeping with biblical principles (Matthew 18:15-17), if you have a dispute or concern related to Haven, we encourage you to first contact church leadership directly to seek an informal resolution. Most issues can be resolved through open communication and Christian fellowship.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions.

14.3 Venue

Any legal action or proceeding arising out of or related to these Terms or Haven shall be brought exclusively in the courts located in Clark County, Kentucky, and you consent to the jurisdiction of such courts.

14.4 Limitation Period

You agree that any claim or cause of action arising out of Haven or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

15. Changes to These Terms

Christ Church of Winchester reserves the right to modify these Terms of Service at any time. When we make material changes, we will:

• Update the "Effective Date" at the top of this document
• Notify users through Haven or by email
• Provide a reasonable opportunity to review the changes

Your continued use of Haven after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using Haven.

16. General Provisions

16.1 Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Christ Church of Winchester regarding Haven and supersede any prior agreements or understandings.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16.3 Waiver

The Church's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of the Church.

16.4 Assignment

You may not assign or transfer these Terms or your Haven account without the Church's prior written consent. The Church may assign these Terms without restriction.

16.5 No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Christ Church of Winchester.
